On February 23, 2023, Trevor Martin’s client (a youth) was found not guilty of sexual assault following a three-day trial in Nanaimo. Mr. Martin had successfully pushed for extensive pre-trial disclosure and was able to use the resulting information in cross-examination to show that the complainant had a motive to fabricate the allegation. Mr. Martin was able to introduce this information into evidence over the objections of the Crown. Mr. Martin’s cross-examination also revealed several inconsistencies in the complainant’s evidence. The client testified in his own defence and denied the offence occurred. After considering all the evidence, the court found the client not guilty, placing significant weight on the weaknesses that were exposed in the Crown’s case.
