Client found not guilty after five-day trial in Kelowna Supreme Court, on fraud and theft charges

On May 10, 2024, Justice Margot Fleming of the BC Supreme Court acquitted our firm’s client of four counts of theft and fraud against her ex-employer. The decision is reported: 2024 BCSC 1912. Elliot Holzman and Melanie Heathman represented the accused. The trial lasted five days and the Crown called six witnesses as part of its case, as well as leading voluminous paper records. In her reasons for acquittal, the judge noted the effectiveness of the defence’s cross-examination of the Crown witnesses and bringing up possible motives for those witnesses to not tell the truth. The defence was also able to show how two of the Crown’s witnesses contacted each other outside of court following their testimony.
