Serious charges dropped after Martland & Saulnier court filing

On October 22, 2024 the Crown Prosecution Service dropped all charges against the firm’s client, three days before a pre-trial application was to be argued. The client was charged with serious offences including sexual assault. Defence counsel Trevor Martin and Elliot Holzman challenged the charges on jurisdictional grounds, and also argued that the prosecution amounted to an abuse of process. The Crown had taken the extraordinary step of laying a “direct indictment” after the start of pre-trial motions in Provincial Court. Usually, a direct indictment moves a case to Supreme Court. The firm’s lawyers argued that the Crown had no jurisdiction to proceed by direct indictment after the trial proceedings had started at the Provincial Court. Rather than contest the challenge, the Crown dropped the case entirely.
