After a 48-day trial at BC Supreme Court, the firm’s client was found not guilty on charges of manslaughter, criminal negligence causing death, and criminal negligence causing bodily harm. The charges arose from a sewer excavation project in Burnaby in 2012, during which a retaining wall collapsed killing one worker and injuring a second. The trial involved expert evidence on workplace safety, excavation and engineering. Brock Martland, KC and Joseph Saulnier were counsel for the foreman, who was acquitted.
